UPDATE ELECTION LAW NEEDS TO BE CHANGED

I WAS ADVISED OF ANOTHER WAY TO CHANGE THE MOHEGAN CONSTITUTION ARTICLE VII-VOTING SECTION 2 WHERE IT READS"IN EACH TRIBAL ELECTION, EVERY REGISTERED VOTING MEMBER SHALL BE ENTITLED TO CAST ONE VOTE FOR EACH ELECTIVE POSITION AVAILABLE"

AGAIN THE PROBLEM, IS THE PHASE "SHALL BE ENTITLED" AND THE ELECTION LAW SAYS "REQUIRED." AS IT STANDS NOW YOU HAVE TO VOTE FOR EVERY POSITION ON THE BALLOT FOR YOUR BALLOT TO COUNT. FOUR POSITIONS OPEN YOU HAVE TO VOTE FOR FOUR PEOPLE. YOU CAN NOT VOTE FOR LESS THAN THE FOUR.

THE ADVISE WAS THAT A TRIBAL MEMBER OR MEMBERS COULD FILE AN ACTION AGAINST THE ELECTION COMMITTEE CHALLENGING THE LAW. THE DECISIONS COULD BE APPEALED, THEN AFTER THE APPEAL IT COULD BE BROUGHT BEFORE THE SUPREME COURT ( COUNCIL OF ELDERS). THEY COULD CHANGE THE CONSTITUTION OR BRING THE MATTER AS AMENDMENT TO THE CONSTITUTION FOR PEOPLE TO VOTE ON. I AM NOT QUITE SURE HOW THE FINAL PROCESS WOULD WORK.

I COULD BE WRONG BUT IF I AM RIGHT WE HAVE THREE DIFFERENT AVENUES TO FIX THE ORDINANCE OR CONSTITUTION ON THIS MATTER. SEE PREVIOUS STORY ENTITLED
